Flowformance Terms & Conditions Effective Date: 29/06/2025 Last Updated: 29/06/2025 Welcome to Flowformance. These Terms & Conditions (“Terms”) govern your use of the Flowformance mobile application, web application, and related services (together, the “Platform”). By accessing or using Flowformance, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. About Flowformance Flowformance is a fitness and wellbeing platform providing general training, activity, and lifestyle guidance. Flowformance does not provide medical advice or healthcare services.

2. Eligibility You must be at least 16 years old to use Flowformance. By using the Platform, you confirm that you meet this requirement.

3. Accounts & Registration When creating an account, you agree to: Provide accurate, complete, and up-to-date information Keep your login credentials secure and confidential Accept responsibility for all activity carried out under your account Flowformance is not responsible for unauthorised access resulting from your failure to protect your login details.

4. Subscriptions & Payments 4.1 Individual Users Access to certain features may require a paid subscription. Pricing and billing terms will be shown at the point of purchase.

4.2 Organisation Accounts Where Flowformance is provided to an organisation, business, or group (“Organisation”), payment responsibility sits with the Organisation, not individual users. Organisation subscriptions are: Must last a minimum 3 month term Monthly only Recurring Billed in advance Pricing is based on the number of active users associated with the Organisation account at the time of billing. For organisations with 100 or more users, pricing starts from £249 per month and may vary depending on user numbers. Payments are processed via Flowformance’s payment providers (including Stripe or GoCardless). The Organisation is responsible for ensuring payment details remain valid and up to date.

5. Notice Period & Cancellation Organisation subscriptions are subject to a one (1) month notice period. Cancellation requests must be submitted at least one full billing month in advance. Access will remain active until the end of the notice period. No refunds are provided for partial billing periods.

6. Health & Wellbeing Disclaimer Flowformance provides general fitness, wellbeing, and lifestyle guidance only. Flowformance: Is not a medical provider Does not provide medical advice, diagnosis, or treatment You should consult a qualified healthcare professional before starting any fitness or wellbeing programme. Use of the Platform is at your own risk.

7. Prohibited Use You must not: Share your login credentials with others Use the Platform for unlawful, harmful, or misleading purposes Upload offensive, inappropriate, or false content Attempt to reverse-engineer, disrupt, or tamper with the Platform Flowformance reserves the right to suspend or terminate accounts for misuse.

8. Organisation Responsibilities Where an Organisation account is used: The Organisation is responsible for inviting and managing users The Organisation must ensure users are aware of and comply with these Terms and the Privacy Policy The Organisation is responsible for communicating Flowformance’s health disclaimer to its users

9. Data Protection & Privacy Flowformance complies with applicable data protection laws, including the UK GDPR. For Organisation accounts: The Organisation acts as the Data Controller Flowformance acts as the Data Processor Flowformance processes personal data solely to provide the Platform and related services, in accordance with its Privacy Policy.

10. Intellectual Property All content, software, branding, training materials, and platform features are owned by Flowformance or its licensors. You may not copy, modify, distribute, or reuse any part of the Platform without prior written permission.

11. Suspension & Termination Flowformance may suspend or terminate access to the Platform immediately where: These Terms are breached Payment fails or remains overdue Misuse or abuse of the Platform is identified Termination does not affect any outstanding payment obligations.

12. Limitation of Liability To the fullest extent permitted by law: Flowformance shall not be liable for any indirect, incidental, or consequential loss, including loss of revenue, profits, productivity, or business opportunity Flowformance does not guarantee specific health, fitness, or wellbeing outcomes Flowformance’s total liability to an Organisation shall not exceed the total fees paid by that Organisation in the 12 months preceding the claim.

13. Changes to These Terms Flowformance may update these Terms from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law These Terms are governed by and construed in accordance with the laws of England and Wales.
